These Terms of Service ("Terms") govern your access to and use of the CAPSLRx website and services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Services.

We reserve the right to update or change these Terms at any time by posting the most current version on our website. Your continued use of the Services after any changes constitute your acceptance of the new Terms.

Pharmacy Benefit Manager Services

CAPSLRx provides pharmacy benefit management (PBM) services to plan sponsors and their enrolled members. Access to specific benefit services is governed by the applicable benefit plan documents and any agreements between CAPSLRx and the plan sponsor. Nothing on this website constitutes a guarantee of specific benefit coverage, pricing, or availability for any individual member.

Pharmacy benefits are subject to formulary changes, prior authorization requirements, and plan design modifications. CAPSLRx does not provide medical or clinical advice. Always consult a licensed healthcare provider regarding your medications and treatment options.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

CAPSLRx does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAPSLRX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

IN NO EVENT SHALL CAPSLRX'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) $25.00 OR (B) THE AMOUNT PAID BY YOU TO CAPSLRX IN THE TWELVE MONTHS PRECEDING THE CLAIM.

User Obligations

By using our Services, you agree to:

  • Provide accurate, current, and complete information as requested during enrollment or contact
  • Maintain the confidentiality of any account credentials and notify us immediately of any unauthorized access
  • Use the Services only for lawful purposes and in compliance with all applicable laws and regulations
  • Not attempt to gain unauthorized access to any portion of the Services or any other system connected to the Services
  • Not transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

Dispute Resolution and Arbitration

Any dispute or claim arising out of or related to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court. The arbitration shall be conducted in Scotts Bluff County, Nebraska, or at a mutually agreed location. The arbitrator's decision will be final and binding.

You waive the right to participate in a class action lawsuit or class-wide arbitration. You and CAPSLRx each agree that all disputes will be resolved on an individual basis only.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of CAPSLRx and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CAPSLRx.

If you opt in to receive text message alerts from CAPSLRx, you consent to receive recurring automated marketing and informational text messages at the phone number provided. Message and data rates may apply. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us directly.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions, except to the extent that applicable federal law governs.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will continue in full force and effect.
